The Australian Migration Agent and Immigration Lawyer Association is the operator of this payment processing page. By accessing, using, or transacting via the Facility you agree that your access or use of the Facility and any transactions conducted via the Facility and associated use is subject to the following terms and conditions, and any terms and conditions incorporated by reference below. If you do not agree, you must not use the Facility.
a. In consideration of Australian Migration Agent and Immigration Lawyer Association providing you with non exclusive and temporary access or use of the Facility, you agree to comply with these terms and conditions, and the terms of any third party service provider (for example, Stripe Payments Australia Pty Ltd) engaged by Australian Migration Agent and Immigration Lawyer Association or you in connection with the Facility. Stripe, Inc. and its global affiliates process transactions (including payment transactions) for Australian Migration Agent and Immigration Lawyer Association.
b. You authorise Australian Migration Agent and Immigration Lawyer Association and third party service providers to take payment of the amount specified from your specified card / account. You must pay the credit card surcharge applicable to the credit card that you use in addition to and at the same time as any amounts that you wish to pay using the Facility. You agree that Australian Migration Agent and Immigration Lawyer Association may add such surcharge of up to 5.5% to the amount specified by you and charge your credit card the amount specified by you plus the applicable credit card surcharge. You agree to use an international card and that Australian Migration Agent and Immigration Lawyer Association shall apply for all payments a credit card surcharge of up to 5.5% for international cards. If you however use an Australian domestic card you may request a refund as the credit card surcharge for an Australian domestic card is usually lower. You can request a refund by emailing to paysafe @ ask-an-agent.com.au confirming that you used an Australian domestic card. The credit card surcharge may include merchant service fees, fraud related chargeback fees, cost of fraud prevention services paid to an external provider or payment facilitator, cost of insuring against forward delivery risk, any other fees incurred in processing card transactions, including cross-border transaction fees, and fraud monitoring related fees paid to an external provider or payment facilitator.
c. Except for any liability which cannot be excluded, restricted or modified by law, Migration International Group and Australian Migration Agent and Immigration Lawyer Association and their officers, employees, agents, and contractors exclude, to the fullest extent permitted by law, all liability whether arising in tort (including, without limitation, negligence), contract or otherwise for any injury, loss, liability, or damage of any kind (including, without limitation, any direct, indirect, special or consequential loss) arising in any way from your access or use of this Facility or its associated features.
d. To the extent that the liability in clause c. cannot be excluded, restricted or modified by law, Migration International Group and Australian Migration Agent and Immigration Lawyer Association, their officers, employees, agents, and contractors limit liability to the relevant credit card surcharges which have been paid, or the cost of resupplying the services in respect of which the breach occurred, at Migration International Group’s option.
e. You hereby release, and agree to indemnify and hold Migration International Group and Australian Migration Agent and Immigration Lawyer Association, their officers, employees, agents, and contractors harmless from any and all liabilities, damages, injury to any person or property, losses, claims and expenses of any kind (including reasonable lawyer fees) which may be incurred as a result of your misuse of the Facility, or breach of the terms.
Pay.Safe Investigation Fee: You may request to have the status of a single payment to be investigated anytime. We incur investigation costs for each request. An Investigation Fee of $25 applies for each request to be investigated. You agree, we charge your credit card without further notice and before we start working on your request. If Pay.Safe made the mistake, we won't charge you the Investigation Fee.
